Terms of Service

1. Provider

These terms govern the use of Firstrun, operated by Softure UG (haftungsbeschränkt), Scharfenberger Straße 28, 13505 Berlin, Germany (HRB 275859 B, Amtsgericht Charlottenburg).

2. Service Description

Firstrun converts documentation, guides, and other technical content into interactive step-by-step walkthroughs (“wizards”) using artificial intelligence, and collects anonymous feedback from users who follow those walkthroughs. Content can be provided via URL, file upload, or direct text paste. The service includes wizard generation, publishing (public or internal/organization-only), and analytics. Generated wizards may reference external resources such as images from the original source documentation, which remain hosted on third-party servers and may become unavailable at any time.

3. Account Registration

You must provide a valid email address and create a password to use the service. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 16 years old to create an account.

4. User Content and License

“User Content” means any material you submit to the service, including URLs, uploaded files, and pasted text.

You retain all ownership rights to your User Content. By submitting User Content, you grant Softure UG a worldwide, non-exclusive, royalty-free license to process, transform, store, and display it solely for the purpose of operating the service — including scraping the submitted URL, parsing uploaded files, processing pasted text, generating wizard content using AI, and displaying published wizards to authorized viewers.

You represent and warrant that you have all necessary rights to submit the User Content and that doing so does not infringe any third-party intellectual property, privacy, or other rights.

5. AI-Generated Content

Wizards are generated using artificial intelligence (large language models). AI-generated content may contain inaccuracies, omissions, or errors. You are solely responsible for reviewing and verifying all generated content before publishing or relying on it. Softure UG does not guarantee the accuracy, completeness, or suitability of any AI-generated output.

End users who follow published wizards do so at their own risk. Softure UG is not liable for any damage, data loss, or other harm resulting from following AI-generated instructions.

6. Publishing and Visibility

You may publish wizards with one of two visibility settings:

• Public: The wizard is accessible to anyone on the internet via its link. You are responsible for ensuring that publicly published content does not violate applicable laws or third-party rights.
• Internal: The wizard is restricted to authenticated members of your organization.

By publishing a wizard as public, you acknowledge that the generated content will be publicly available and may be indexed by search engines.

7. Acceptable Use

You agree not to:

• Submit URLs, upload files, or paste content that is illegal, harmful, defamatory, or infringing
• Use the service to scrape, reproduce, or redistribute copyrighted material without authorization from the rights holder
• Upload files containing malware, viruses, or other harmful code
• Submit content containing personal data of third parties without their consent
• Attempt to interfere with or disrupt the service
• Use automated means to access the service beyond normal API usage
• Impersonate another person or entity
• Publish wizards containing instructions that could cause harm, damage systems, or facilitate illegal activity

8. Copyright and Takedown (DMCA / EU DSA)

If you believe that content on Firstrun infringes your copyright or other intellectual property rights, please contact us at customers@softure-ug.de with:

• Identification of the copyrighted work and the infringing content
• The URL of the infringing wizard
• Your contact information and a statement that you have a good-faith belief the use is unauthorized

We will investigate and, where appropriate, remove or disable access to the infringing content promptly.

9. Intellectual Property

The Firstrun platform, its source code, design, and branding are the property of Softure UG. Nothing in these terms grants you any right to use our trademarks, logos, or branding.

10. Availability and Warranty

The service is provided “as is” and “as available” without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or accuracy of AI-generated content. We do not guarantee uninterrupted availability. We may modify, suspend, or discontinue the service at any time with reasonable notice.

11. Limitation of Liability

To the extent permitted by law, Softure UG shall not be liable for any indirect, incidental, or consequential damages arising from the use of the service, including but not limited to damages arising from reliance on AI-generated wizard content, data loss, or system damage caused by following wizard instructions. Our total liability is limited to the amount paid by you for the service in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Softure UG from any claims, damages, or expenses (including reasonable legal fees) arising from: (a) your User Content; (b) your use of the service; (c) your violation of these terms; or (d) your infringement of any third-party rights.

13. Termination

You may delete your account at any time. We may terminate or suspend your access for violation of these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy. Published public wizards will be taken offline upon account deletion.

14. Governing Law

These terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction is Berlin, to the extent permitted by law.

15. Changes

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance. We will notify registered users of material changes via email at least 14 days before they take effect.
